Legal & Procedural Process in South Africa

Below is an outline of the steps and legal requirements under SA law when someone dies, to help families understand what needs to be done and who is responsible.

  • Pronouncement of Death & Medical Certificate

    A medical practitioner must issue a death certificate or a cause of death certificate. If death was outside a medical facility, there may need to be a Doctor /

    Public Health / Police involvement.

  • Funeral director appointment

    You select a funeral parlour (such as New Life Burials) to manage removal, preparation, and arrangements. They assist with procurement of necessary documents.

  • Transport & Mortuary

    If death was outside hospital, transported to mortuary; embalming may be required for certain transport (especially if transporting over long distances or overseas) or for certain cultural/religious needs.

  • Notification & Registration

    The death must be reported to the Department of Home Affairs so that a

    Death Certificate can be issued. Necessary forms (e.g. Notification of Death or Still Birth Form, Form BI‑1663) are completed. The Registrar issues an abridged or full Death Certificate.

  • Venue, Service and Burial / Cremation

    Coordination with cemetery or crematorium. Permits required for cremation. Burial requires municipal paperwork. Observe time limits and

    environmental‑health requirements.

  • Death Certificate handover

    Once registered, the Death Certificate is needed by many entities (banks, insurers, pension funds).
